Terms and Conditions of Sale (updated 04/10/23)
All terms used should be understood in their gender-neutral sense.

1. General Terms

Any contract established between the Training Institute for Psychology & Health (TIPH) and the buyer is subject to the application of our Terms and Conditions of Sale (T&Cs). These terms and conditions apply without restriction or reservation to all products offered for sale by the Training Institute for Psychology & Health (TIPH) (notably but not exclusively through the websites www.burnoutparental.com, www.parentsurlefil.com, https://learning.tipsychologyhealth.com, https://www.tipsychologyhealth.com/fr/, and through the TIPH Learnybox platform).By ordering a service from TIPH, a natural or legal person fully accepts these terms and conditions of sale. These are accessible at all times and will prevail, if applicable, over any other version and over the customer's own purchase conditions.

2. Characteristics of Products and Services Offered

The products (items, conferences, programs, training, supervision, etc.) offered by TIPH are all produced professionally. However, only the consumer is responsible for the proper use of the products. The items, training, programs (online or on-site), and conferences (online or on-site) do not replace medical, psychological, or psychiatric advice, nor specialized consultation. TIPH disclaims all responsibility for the use made by the client of the information or tools provided. For online programs, training, and conferences, the user must have hardware (tablet, computer, or mobile phone) and a good quality wifi connection (min. 25 Mb/s.) to follow the program, as it is based on video use.

3. Prices and Payment Terms

Prices are indicated in Euros (EUR). They may be indicated in local currency (this is not always the case) when an order is placed from abroad. If the prices are not understood in Euros, the currency is always stated. Prices are expressed either excluding taxes (HT) or including all taxes (TTC). Whether the price is understood as HT or TTC is always indicated. Any new tax or increase in rates may be passed on without express declaration. Prices may be adjusted at any time. However, the prices applicable to the order are those in effect at the time of confirmation.

Purchases must be paid for in full, either online or to the bank details mentioned on the invoice, on the site and/or in the confirmation email, in order to validate the order. Proper payment will serve as confirmation from the consumer and will validate the order. TIPH disclaims all responsibility in the event that the banking institution charges additional fees if the transaction is not carried out in the same currency as that of your bank account.

4. Orders

To purchase a product (conference, program, training, conference, supervision, etc.) from TIPH, one must:

Be at least 18 years old;

Have read and agreed to these terms and conditions of sale as well as the Privacy Policy. Any order implies acceptance of the terms and conditions of sale and the Privacy Policy;

Confirm the order by paying for the items (taxes included, if applicable).

The order is confirmed upon receipt of payment.

If you wish to modify an order, please contact TIPH within 24 hours following the order at admin@tipsychologyhealth.com. Depending on possibilities and deadlines, TIPH reserves the right to accept or refuse this modification request.

5. Payment

For online training aimed at professionals, payment for the order is made by bank transfer or online at the time of ordering or directly to account BE81 0689 3416 7924 in the name of the Training Institute for Psychology & Health. Only the actual receipt of payment including the amount corresponding to the ordered items validates the order.

For the "Parent on the Edge" program aimed at parents, payment for the order is made online at the time of ordering or directly to account BE81 0689 3416 7924 in the name of the Training Institute for Psychology & Health. Payment is made in 12 monthly installments for 12 months of access to the program; the payment of the first installment validates the order and binds the client to pay the subsequent installments due. In the event of non-payment and absence of regularization following the reminder, access to the program will be disabled.

For on-site services (training, conferences, supervision), the order is validated based on the signing of a quote corresponding to the ordered services and products, and acceptance of the terms and conditions of sale. Payment for the order is made by bank transfer directly to account BE81 0689 3416 7924 in the name of the Training Institute for Psychology & Health, based on an invoice sent to the client after the TIPH service. TIPH disclaims all responsibility in the event of additional customs fees, banking fees, or currency conversion changes, for example.

6. Delivery Time

For online training and programs aimed at professionals or the general public: the ordered and validated products are delivered online. Login credentials and passwords to access the training programs and products are sent to the email address provided by the client. The client is responsible for checking their "spam" and "promotions" folders if the login credentials and passwords have not arrived in their inbox.

In the absence of sending these, the client should promptly email admin@tipsychologyhealth.com.

Order processing occurs automatically within a few minutes for online orders. It may take between 1 and 5 business days in the case of bank transfer. Any bank transfer must be accompanied by a prior email indicating the order to admin@tipsychologyhealth.com.

For on-site services (conferences, training, supervision, etc.): the services and products ordered and validated based on a quote are delivered on the agreed-upon date mutually established between the client and TIPH.

7. Geographical Availability

For online training and programs aimed at professionals or the general public: the online products offered on the TIPH websites are created in Belgium. They are accessible from any location in the world with high-speed internet access. High-speed internet is justified by the presence of numerous videos. TIPH disclaims all responsibility in the event of ordering a training product from a geographical location or using equipment that does not have high-speed internet access.

For on-site services (conferences, training, supervision, etc.): the ordered and validated products based on a quote are delivered at the place mutually agreed upon between the client and TIPH.

8. Complaints

Any complaint and/or dispute from the consumer must be made by email to admin@tipsychologyhealth.com.

9. Right of Withdrawal

In accordance with applicable legislation, the consumer has a right of withdrawal of 14 days by completing the downloadable form here: https://economie.fgov.be/sites/default/files/Files/Ventes/Forms/Formulaire-de-retractation.pdf and returning the form to admin@tipsychologyhealth.com.

Only unused items (progress indicated on Learnybox serves as proof for online products) are eligible for a refund. The seller commits to refund the buyer within 14 days after verifying the non-consumption of the product and acceptance of the refund.

10. Cancellation

In the event of cancellation of an on-site service (conferences, training, supervision, etc.) by the contracting party, a flat fee of 150 euros excluding VAT will be charged for various administrative costs. Costs already incurred by TIPH (train, hotel, for example) will also be reimbursed by the contracting party based on proof of payment.

In the event of cancellation of an on-site service (conferences, training, supervision, etc.) by TIPH after the quote has been signed by the contracting party, TIPH will pay compensation corresponding to the expenses incurred by the injured party at the date of cancellation of the contract (room rental, e-commerce fees on already reserved and paid places…). Other dates may be proposed.

Neither the provider (TIPH) nor the contracting party can be held responsible for the cancellation of an on-site service (conferences, training, supervision, etc.) in case of force majeure, meaning an event that cannot be anticipated (unforeseeable), cannot be overcome (irresistible), and/or corresponds to an external fact beyond the control of the person concerned.

11. Responsibilities

TIPH is committed to doing everything possible to ensure that clients have quality products.

The consumer (whether a professional or the public, depending on whether it is a product intended for professionals or the public) is responsible for the proper use of the products. The information, questionnaires, tests, and tools offered as part of our programs or training do not replace medical, psychological, or psychiatric advice, nor specialized consultation.

TIPH disclaims all responsibility for how the client uses the information or tools provided. TIPH disclaims all therapeutic responsibility.

For online training and programs aimed at professionals or the public: TIPH cannot be held responsible for damage resulting from the use of the internet, loss or theft of data, intrusions, viruses, interruptions of service or any other involuntary problems.

TIPH is committed to taking all necessary measures to protect consumers' personal data in compliance with the rules detailed in the GDPR (see our Privacy Policy). TIPH cannot be held responsible in case of attempts at malicious cyberattacks or theft, particularly to recover clients’ data. TIPH reserves the right to take legal action with the competent authorities to protect its clients.

TIPH disclaims all responsibility in the event of inaccuracies in the data provided by the consumer (whether in processing orders or referencing).

12. Intellectual Property

TIPH sells products for which it holds the rights. The images and videos used are also royalty-free or created directly by TIPH. Any resemblance to other works is purely coincidental.

The articles, training (online or on-site), and conferences (online or on-site) (and all their contents) are the property of TIPH and the exclusive intellectual property of the authors. These authors are mentioned on each training product. In the absence of explicit mention, the authors are Isabelle Roskam and Moïra Mikolajczak. No one is authorized to reproduce, exploit, or disseminate even partially these elements without citing the authors or without their written consent.

The TIPH websites and its articles can only be referenced in compliance with the law and in a manner that does not tarnish its reputation or that of its authors. Links that do not comply with this rule may be disabled at any time and without notice.

13. Referencing and Certification
Some of our training programs aimed at professionals lead, upon successful completion of all assessments (see educational charter for success conditions), to certification (i.e., the issuance of a certificate of success) and/or free professional referencing on the websites www.burnoutparental.com and www.tipsychologyhealth.com/fr/. Only professionals who have paid the required amount according to their country of residence and the geographical location of their activities will be eligible for this certification and referencing in the event of success in the assessments. Professionals who purchased the training at developing country rates while residing and/or working in a country subject to full price will be denied certification and referencing. Professionals who purchased the training without having the required qualifications beforehand and without having received authorization from TIPH to enroll in the training will also be denied certification and referencing.

14. Disputes
TIPH and the consumer agree to prioritize amicable mediation (in French or English) in the event of a dispute before engaging in legal proceedings.
In case of failure of mediation, any dispute will be finally settled by the Belgian courts of the registered office of the Training Institute for Psychology & Health.

15. Validity of the Terms and Conditions of Sale
TIPH reserves the right to modify, correct, add, or delete any part of these conditions without having to notify the users of the site, who remain responsible for consulting them when they wish and, in any case, prior to any order.
