General Terms and Conditions of Sale (Updated on 22.01.2025)

All terms used herein shall be understood as gender-neutral.

1. Definitions

1.1 TIPH: Training Institute for Psychology and Health SRL, with company number 0727441602, located at Courbevoie 6 Boîte 2, 1348 Ottignies-Louvain-la-Neuve.

1.2 Consumer Client: Any client (natural person) habitually residing in Belgium and acting primarily for private purposes. TIPH maintains a B2C relationship with such clients.

1.3 Business Client: Any client (natural person) conducting an independent activity, or any client (legal entity), as well as any other client (organization without legal personality). TIPH maintains a B2B relationship with such clients.

1.4 Client: Any Consumer Client or Business Client.

2. General Terms

Any contract established between the Training Institute for Psychology & Health (TIPH) and the Client is subject to the application of these General Terms and Conditions of Sale (GTCS).

These general terms and conditions of sale or service provision apply, without restriction or reservation, to all products offered for sale by the Training Institute for Psychology & Health (TIPH) (notably, but not exclusively, through the websites www.burnoutparental.com, www.parentsurlefil.com, https://learning.tipsychologyhealth.com, https://www.tipsychologyhealth.com/fr/, and via TIPH’s Learnybox platform).

Provisions or conditions that derogate from, modify, or supplement these terms shall bind TIPH only if explicitly accepted in writing.

If the offer and acceptance refer to different general conditions, the contract is nonetheless formed. Both general conditions shall form part of the contract, except for incompatible clauses, unless TIPH has explicitly accepted such incompatible clauses in writing.

The invalidity of a provision or part of a provision in the GTCS shall not affect the validity of the remaining provisions or parts thereof.

3. Characteristics of Products and Services Offered

The products (articles, conferences, programs, training, supervisions, etc.) provided by TIPH are delivered with professionalism. However, the Client is solely responsible for the proper use of these products. Articles, training, programs (online or on-site), and conferences (online or on-site) do not replace medical, psychological, or psychiatric advice, nor do they substitute for specialized consultations.

TIPH disclaims all liability for the Client's use of the information or tools provided.

For online programs, training, and conferences, the Client must have a hardware device (tablet, computer, or mobile phone) and a high-quality Wi-Fi connection (minimum 25 Mbps) to access the program, as it relies on video-based content.

4. Prices and Payment Terms

4.1 Prices are quoted in Euros (EUR). They may be displayed in local currency when an order is placed from abroad. If prices are not in Euros, the currency will always be indicated. Preferential rates may apply to clients residing in developing countries.

The price for the “Parent sur le fil” program displayed on the website https://parentsurlefil.com/ is inclusive of all taxes (VAT included). However, prices for online training aimed at professionals sold on TIPH’s website (https://www.tipsychologyhealth.com/fr/) are shown excluding VAT (excl. VAT) on the first sales page. The applicable VAT depends on the buyer’s country and whether they are subject to VAT. When completing the purchase form, the Client provides their country and potential VAT number, and the program adjusts the price accordingly. The Client always sees the total price, including VAT, before confirming the purchase and making the payment. Applicable prices at the time of order confirmation shall apply.

4.2 For professional online training, payment is made by bank transfer or online at the time of order, or directly to the account BE81 0689 3416 7924 in the name of Training Institute for Psychology & Health. Only effective receipt of payment corresponding to the ordered items validates the order.

For the “Parent sur le fil” program for parents, payment is made online at the time of order or directly to the account BE81 0689 3416 7924. Payment is made in 12 monthly installments, granting 12-month access to the program. The payment of the first installment validates the order and commits the Client to pay the subsequent installments.

For on-site services (training, conferences, or supervisions), the order is validated based on the signature of a quote corresponding to the services and products ordered and acceptance of the GTCS. A deposit of 30% is required upon signing the quote. The balance of the payment is made by bank transfer to the account BE81 0689 3416 7924, based on an invoice sent to the Client after the service is provided.

4.3 In case of non-payment of (part of) the invoice by a Consumer Client by the due date (14 days following the invoice’s issuance), an initial reminder free of charge and without surcharge will be sent. If non-payment persists 14 days after the first reminder, the invoice will be forwarded to a collection agency. The recovery and execution costs arising after the first reminder shall be borne by the defaulting Consumer Client.

For the “Parent sur le fil” program specifically: in case of non-payment and absence of rectification following a reminder, TIPH will suspend the contract’s execution and deactivate access to the program. Access may be reactivated upon request once outstanding payments are settled.

4.4 TIPH disclaims responsibility for any additional fees charged by the banking institution if the transaction is conducted in a currency different from the account’s currency or for any customs or additional banking fees incurred.

5. Orders

To purchase a product (conference, program, training, supervision, etc.) from TIPH, the Client must:

  • Be 18 years or older;
  • Have read and agreed to these GTCS and the Privacy Policy. Placing an order constitutes acceptance of the GTCS and the Privacy Policy;
  • Confirm the order by paying for the items (including taxes, if applicable).

The order is confirmed upon receipt of payment.

To modify an order, the Client must contact TIPH within 36 hours of placing the order at admin@tipsychologyhealth.com. Depending on product availability and timing, TIPH reserves the right to accept or refuse the modification request.

6. Delivery Times

For online training and programs for professionals or the general public: ordered and validated products are delivered online. Login credentials to access training programs and materials are sent to the email address provided by the Client. The Client is responsible for checking their “spam” or “promotions” folders if login credentials do not arrive in their inbox.

If credentials are not received, the Client must promptly email admin@tipsychologyhealth.com.

Orders are processed automatically within minutes for online purchases. Bank transfer orders may take 1 to 5 business days. Bank transfers must be accompanied by a prior email indicating the order to admin@tipsychologyhealth.com.

For on-site services (conferences, training, supervisions, etc.): ordered and validated services are provided on the date mutually agreed upon by the Client and TIPH.

7. Geographical Availability

For online training and programs aimed at professionals or the general public: the online products offered on TIPH websites are created in Belgium. They are accessible from anywhere in the world with high-speed internet access. High-speed internet is required due to the extensive video content. TIPH disclaims all liability for the purchase of training products from a geographic location or on devices that do not have high-speed internet access.

For on-site services (conferences, training sessions, supervisions, etc.): the products ordered and validated based on a quote are delivered at the location mutually agreed upon by the client and TIPH.

8. Complaints

All complaints and/or disputes from the client must be submitted by email to admin@tipsychologyhealth.com within 3 days from the time the defect is known or could reasonably have been known.

All invoices are considered accepted unless protested via registered mail within 5 business days following the order (the postmark serving as proof).

9. Withdrawal Period

In accordance with current legislation, the consumer client has a right of withdrawal of 14 days by completing the form available here: https://economie.fgov.be/sites/default/files/Files/Ventes/Forms/Formulaire-de-retractation.pdf and sending the completed form to admin@tipsychologyhealth.com.

Only unused items (as evidenced by progress tracking on Learnybox for online products) are eligible for a refund.

TIPH commits to refunding the buyer within 14 days after verifying the non-consumption of the product and approving the refund request.

10. Cancellation

In the event of a cancellation of an on-site service (conferences, training sessions, supervisions, etc.) by the client, a flat fee of €150 (excluding VAT) will be charged for various administrative costs. Additionally, expenses already incurred by TIPH (e.g., train, hotel) will be reimbursed by the client based on proof of payment.

In the event of a cancellation of an on-site service (conferences, training sessions, supervisions, etc.) by TIPH after the quote has been signed by the client, TIPH shall pay compensation corresponding to the expenses incurred by the affected party as of the contract cancellation date (e.g., venue rental, e-commerce fees on already reserved and paid spots). Alternative dates may be proposed.

Neither TIPH nor the client shall be held liable for the cancellation of an on-site service (conferences, training sessions, supervisions, etc.) in cases of force majeure, defined as an event that is unforeseeable, insurmountable, and/or external to the control of the affected party.

11. Liability

TIPH commits to making every effort to provide clients with high-quality products.
The client is responsible for the proper use of the products. The information, questionnaires, tests, and tools provided as part of TIPH programs or training sessions do not replace medical, psychological, or psychiatric advice, nor do they substitute for specialized consultations.

TIPH disclaims all liability for the client’s use of the information or tools provided. TIPH does not assume any therapeutic responsibility.

For online training and programs, TIPH cannot be held liable for damages resulting from internet network use, data loss or theft, intrusions, viruses, service disruptions, or other unintentional issues.

TIPH commits to doing everything possible to protect clients’ personal data in compliance with GDPR rules (see our Privacy Policy). TIPH shall not be held liable in the event of a malicious cyberattack or theft aimed at accessing client data. TIPH reserves the right to take legal action with the appropriate authorities to protect its clients.

TIPH disclaims all responsibility in cases of inaccurate data provided by the client (whether related to order processing or referencing).

12. Intellectual Property

TIPH offers products for sale for which it holds rights. The images and videos used are also royalty-free or directly created by TIPH. Any resemblance to other works is purely coincidental.

The articles, training sessions (online or on-site), and conferences (online or on-site), along with their content, are the property of TIPH and the exclusive intellectual property of the authors. The authors are identified on each training product. In the absence of explicit mention, the authors are Isabelle Roskam and Moïra Mikolajczak. No one is authorized to reproduce, use, or distribute any part of these materials without citing the authors or obtaining their written consent.

TIPH websites and articles can only be referenced legally and provided that their reputation or that of their authors is not harmed. Links that violate this rule may be deactivated at any time without prior notice.

13. Referencing and Certification

Some of our training sessions aimed at corporate clients may entitle participants, upon successful completion of all assessments (see the pedagogical charter for success criteria), to certification (i.e., obtaining a certificate of completion) and/or free professional referencing on the websites www.burnoutparental.com and www.tipsychologyhealth.com/fr/.

Only corporate clients who have paid the applicable amount based on their country of residence and the geographical location of their activities will be eligible for certification and referencing upon successful completion of assessments.

Corporate clients who purchased training at the rate designated for developing countries, while domiciled and/or operating in a country subject to full pricing, will be denied certification and referencing.

Corporate clients who purchased training without the required qualifications and without prior authorization from TIPH to enroll in the training will be denied certification and referencing.

14. Disputes

These terms are governed by Belgian law.

TIPH and the client agree to prioritize amicable mediation (in French or English) in the event of a dispute before pursuing legal action.

If mediation fails, any dispute will be definitively resolved by the Belgian courts of the registered office of the Training Institute for Psychology & Health.

15. Validity of the General Terms and Conditions of Sale

TIPH may modify these General Terms and Conditions of Sale. In such cases, changes will be communicated to clients via email at least one (1) month before they take effect. The changes will only apply to new orders placed after their effective date. Prior orders will remain subject to the terms in effect at the time they were concluded.

In the event of substantial modifications to the general terms and conditions, clients will be informed and will have the opportunity to terminate their contract free of charge before the new terms take effect.
