Terms and Conditions

All the terms used must be understood in a gender-neutral sense.

1. General terms

The Terms and Conditions of Sale shall apply to any contract established between the Training Institute for Psychology & Health (TIPH) and the client.

 

These terms and conditions of sale, or of provision of services, apply to all of the products sold by the TIPH (particularly via the websites www.burnoutparental.comhttps://parental-burnout.comhttps://www.parental-burnout-training.com/https://www.tipsychologyhealth.com/en/, and via the TIPH Learnybox platform), without exemptions or reservations.

 

The act of a natural or legal person placing an order on one of these sites implies full and complete acceptance of these terms and conditions of sale. They are accessible at any time and, if applicable, shall prevail over any other version and over the client’s own general purchasing conditions.

 

2. Nature of the products and services offered

The products offered on our websites have been professionally produced. However, only the consumer (the practitioner or the parent, depending on if it is a programme for practitioners or parents) is responsible for the correct use of the products. The articles, training modules and programmes cannot not replace any medical, psychological or psychiatric advice, nor do they replace any specialist consultation.

The TIPH does not accept any liability for the client’s use of the information or tools provided.

 

3. Prices and payment methods

The prices are shown in euro (EUR). Although not always shown, these prices may be stated in a local currency when an order is made outside of Belgium. If the prices are not in euro, the currency will always be indicated. The prices are shown either excluding or including tax, which will always be indicated next to the price. Any new tax or tax increase may be added without any further notice. The price may be amended at any time. However, the prices applied to an order remain in effect when the order is confirmed.

In order to validate an order, purchases must be paid in full either online or via the bank account details mentioned on the website and in the confirmation e-mail. The correct and timely payment will serve as confirmation from the client and will validate the order.

The TIPH does not accept any responsibility should a banking institution charge additional fees due to the transaction not being made in the same currency as that of the client’s bank account.

 

4. Orders

In order to purchase an item (programme, training or update) on a TIPH website,  a person must be:

- At least 18 years old;

- Confirm the order by paying for the items (including taxes, if applicable);

- Read and agree to these terms and conditions of sale as well as the confidentiality policy. Any order constitutes an acceptance of the terms and conditions of sale and the confidentiality policy.

 

The order is confirmed upon receiving payment.

To amend an order, please contact the TIPH no later than 24 hours after the order at contact@tipsychologyhealth.com. Depending on the options available and delivery, the TIPH reserves the right to accept or refuse any amendment requests.

 

5. Payment

The order is paid for online when ordering or is paid directly (or via GoCardLess) to account BE81 0689 3416 7924 of the Training Institute for Psychology & Health. The order is only validated upon receiving the payment for the amount corresponding to the ordered items.

The TIPH does not accept any responsibility for additional charges such as customs charges, bank charges or currency conversion fees.

 

6. Delivery

The ordered and validated products will be delivered online. The usernames and passwords to access the training programmes and products will be sent to the e-mail address entered by the client. The client is responsible for checking their spam folder if the usernames and passwords have not arrived in their inbox.

 

If the client does not receive this e-mail, they must write to contact@tipsychologyhealth.com as soon as possible.

 

Online order are automatically processed within a few minutes. It may take 1-5 working days for a bank transfer to clear. All bank transfers must be accompanied by an e-mail referencing the order, sent in advance to contact@tipsychologyhealth.com.

 

7. Geographical availability

The products offered on the TIPH website are created in Belgium and can be accessed from anywhere in the world with high speed Internet access. The high speed is needed for the video content included. The TIPH does not accept any responsibility should a training product be ordered from a geographical location or from computer equipment that does not have a high speed Internet connection.

 

8. Complaints

Any consumer complaints and/or disputes must be submitted by e-mail to

contact@tipsychologyhealth.com.

 

9. Cancellation

In accordance with current legislation, the client can exercise their right to cancel within 14 days by sending by both an email and a regular mail containing their name and surname, address and email address, complete name of product which purchase they want to cancel, date and signature (date as per postmark). Mail must be addressed to TIPH, Route de Gembloux 72, B-5310 Eghezee, Belgium.

Only non-consumed articles (with the progression displayed on Learnybox used as proof) are eligible for a refund.

The seller agrees to refund the client within 14 days after verifying that the product has not been consumed and after agreeing to the refund.

 

10. Liability

The consumer (the practitioner or the parent, depending on if it is a programme for practitioners or parents) is responsible for the correct use of the products. The information, questionnaires, tests and tools provided as part of our programmes or training cannot replace any medical, psychological or psychiatric advice, nor do they replace any specialist consultation.

The TIPH does not accept any liability for the client’s use of the information or tools provided. The TIPH does not accept any therapeutic responsibility.

 

The TIPH agrees to make every effort to provide quality training to clients . However, the TIPH cannot be held responsible for damages resulting from use of the Internet, loss of data, data breaches, viruses, service interruption or any other unintentional issue.

 

The TIPH agrees to make every effort to protect the personal data of consumers in accordance with the provisions set out in the GDPR (see our confidentiality policy). The TIPH cannot be held responsible for a malicious cyber-attack, particularly in recovering its client’s data. The TIPH reserves the right to take legal action with the competent authorities in order to protect its clients.

 

The TIPH does not accept any responsibility for inaccurate data provided by the consumer (whether in terms of processing an order or in referencing an order).

 

11. Intellectual property

The TIPH sells infoproducts to which it holds the rights. Furthermore, the images and videos used are free of copyright or are the direct creation of the TIPH. Any resemblance to other works is entirely coincidental.

The programmes and training courses as well as all of their content are the property of the TIPH and the exclusive intellectual property of the training module authors. These authors are mentioned in each training product. In the absence of any explicit mention, the authors are Isabelle Roskam and Moïra Mikolajczak. Nobody is authorised to reproduce, use or distribute these elements, even partially, without citing the authors or without written permission.

The TIPH websites and its articles may only be referenced in accordance with the law and provided that it does not undermine its reputation or that of its authors. Any links that do not respect this rule may be deactivated at any time and without warning.

 

12. Referencing and certification

Some of our training programs for professionals give the right, in case of success in all the assessments (see pedagogical charter for the conditions of success), to a certification (= obtaining a certificate of achievement) and/or to a free professional referencing on the websites www.burnoutparental.com and https://www.tipsychologyhealth.com/en/. Only the professionals who have paid the amount due according to their country of residence and the geographical location of their activities will be able to obtain this certification and this referencing in case of success of the assessments. Professionals who have purchased the training at the developing country price while they are domiciled and/or practicing in a country that is subject to the full price will be denied certification and referencing.

 

13. Disputes

The TIPH and the consumer agrees to prioritise amicable mediation (in French or in English) in the event of a dispute before taking any legal action.

In the event that this mediation fails, any dispute shall be finally resolved by the Belgian courts local to the Training Institute for Psychology & Health’s head office.

14. Validity of the Terms and Conditions of Sale

The TIPH reserves the right to modify, rectify, add or remove any part of these terms and conditions, without needing to warn website users, who remain responsible for consulting the terms when they want and particularly
